Acceptance of These Terms

Welcome to Safirtec Insurance Agency LLC (“Safirtec” or “we”).

These Terms and Conditions (“Terms”) govern your access to and use of safirtecinsurance.com, including its pages, forms, quote-request features, educational materials, and related online services (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please discontinue use of the Site.

You must be at least 18 years old, or the legal age required to enter into an agreement in your jurisdiction, to submit an insurance application or purchase insurance through Safirtec.

About Safirtec

Safirtec is a licensed independent insurance agency serving individuals, families, and businesses in the states where it is legally authorized to operate.

Safirtec works with licensed insurance carriers and other authorized insurance-market partners to provide personal, commercial, life, health, and related insurance products and services.

When you voluntarily submit a request through the Site, an online advertisement, referral source, or other authorized channel, you are requesting information from Safirtec.

Safirtec may contact individuals who request insurance information. We do not sell consumer leads or personal information to other businesses.

Insurance products are not available in every state. Product availability, coverage, pricing, and eligibility depend on applicable licensing requirements, insurance carrier rules, underwriting, and state law.

General Insurance Information

Information presented on the Site is provided for general educational and informational purposes. It is not a complete description of any insurance policy, coverage, exclusion, condition, limitation, or endorsement.

Website content alone does not constitute an individualized insurance recommendation. It is not legal, tax, accounting, medical, or investment advice.

Insurance coverage is governed exclusively by the actual policy, declarations, endorsements, exclusions, conditions, and documents issued by the applicable insurance carrier. If information on the Site differs from an issued insurance policy, the policy documents control.

Insurance Quotes and Applications

Submitting a quote request or application does not constitute:

  • Insurance coverage

  • An insurance binder

  • Acceptance of risk

  • Policy issuance

  • Guaranteed eligibility

  • Guaranteed pricing

  • Guaranteed coverage

  • Carrier approval

Quotes are estimates based on the information available at the time they are prepared. Rates, premiums, coverage, deductibles, eligibility, and payment requirements may change after underwriting or carrier review.

All insurance products remain subject to:

  • Underwriting

  • Carrier eligibility requirements

  • Carrier approval

  • Verification of submitted information

  • Applicable laws and regulations

  • Policy terms, exclusions, conditions, and limitations

  • Payment and documentation requirements

Safirtec does not control the final underwriting, eligibility, pricing, cancellation, nonrenewal, or claim decisions made by an insurance carrier.

Binding and Changes to Coverage

Completing a form, requesting a quote, sending an email or text message, leaving a voicemail, uploading a document, or submitting a payment does not, by itself:

  • Create or bind coverage

  • Add or remove coverage

  • Change policy limits

  • Add or remove an insured, driver, vehicle, property, or business location

  • Renew or reinstate a policy

  • Cancel a policy

Coverage becomes effective only when binding has been expressly confirmed by an authorized insurance carrier or properly authorized representative in a manner permitted by applicable law, and all required conditions have been satisfied.

For your protection, obtain and retain confirmation of coverage before relying on a requested insurance transaction.

Do not cancel existing insurance until you have confirmed that replacement coverage is effective.

User Responsibilities

By submitting information to Safirtec, you represent that:

  • The information is accurate and complete to the best of your knowledge

  • You are authorized to provide the information

  • You have the authority to act for any person or business identified in the request

  • You will notify Safirtec promptly if relevant information changes

  • You will review quote, application, payment, binder, and policy documents for accuracy

Inaccurate, incomplete, or misleading information may affect eligibility, pricing, coverage, policy issuance, cancellation, or claim decisions.

You are responsible for reviewing all documents issued by the insurance carrier and notifying Safirtec promptly of any errors or requested corrections.

Payments

Payment information provided through the Site or an authorized payment method may be processed by an insurance carrier, premium finance company, payment provider, or other authorized service provider.

Submitting a payment does not guarantee that coverage has been bound, issued, renewed, or reinstated. You are responsible for confirming the status and effective date of coverage.

Safirtec is not responsible for carrier decisions involving payment plans, returned payments, late fees, cancellation, reinstatement, or premium adjustments.

Policy Servicing and Cancellation Requests

Requests involving policy changes, renewals, certificates, cancellations, or other policy services are not effective until processed and confirmed by the appropriate carrier or authorized representative.

Do not assume that a request has been completed merely because it was submitted through the Site, email, telephone, SMS, or voicemail.

You are responsible for reviewing any confirmation, endorsement, cancellation notice, or revised policy document provided in response to your request.

Claims Assistance

Safirtec may provide general assistance with locating carrier claim information or communicating with an insurance carrier. Safirtec does not control claim investigations, coverage determinations, settlements, payments, or claim-processing timelines.

Claims should be reported directly to the appropriate insurance carrier as soon as reasonably possible and in accordance with the applicable policy.

The Site should not be used to report emergencies. In an emergency, contact 911 or the appropriate emergency service.

Telephone and Email Communications

When you voluntarily provide contact information and request insurance information, you authorize Safirtec to contact you by telephone or email regarding your inquiry.

  • Quote follow-ups

  • Requests for information or documents

You may request that these communications stop at any time.

These Terms do not replace any additional consent required by applicable law for automated, prerecorded, or marketing communications.

Electronic Communications

When permitted by applicable law and when you elect to communicate electronically, you consent to receive communications from Safirtec electronically.

Electronic communications may include:

  • Emails

  • Electronic documents

  • Electronic signatures

  • Telephone calls

  • SMS messages when consent has been provided

  • Online notifications

To the extent permitted by applicable law, electronic records and communications may satisfy requirements that information be provided in writing.

You are responsible for maintaining accurate contact information and for ensuring that you can access, download, and retain electronic communications.

If you voluntarily provide your mobile telephone number and expressly consent to receive SMS messages, Safirtec may send text messages regarding:

  • Quote requests and updates

  • Policy servicing

  • Renewal reminders

  • Customer support

  • Requested insurance information

If separately authorized, Safirtec may also send occasional promotional messages concerning insurance products and services.

Consent to receive marketing text messages is not required as a condition of purchasing insurance, receiving a quote, or obtaining services.

Wireless carriers are not responsible for delayed or undelivered messages. Message delivery is not guaranteed and may be affected by your device, wireless service, network availability, or other factors outside Safirtec’s control.

You are responsible for providing a valid mobile number and notifying Safirtec if the number changes or is reassigned.

Your use of the Site is also governed by Safirtec’s Privacy Policy, which explains how personal information is collected, used, disclosed, retained, and protected.

The Privacy Policy is incorporated into these Terms by reference and should be linked on the Site.

Intellectual Property

All Site materials—including text, graphics, logos, trademarks, icons, images, forms, layouts, videos, software, and downloadable materials—are owned by or licensed to Safirtec and are protected by applicable intellectual-property laws.

Safirtec grants you a limited, revocable, nonexclusive, and nontransferable right to access and use the Site for personal or legitimate business insurance purposes.

Without prior written permission, you may not:

  • Copy, reproduce, modify, republish, or distribute Site materials

  • Use materials for unauthorized commercial purposes

  • Remove copyright, trademark, or proprietary notices

  • Attempt to reverse engineer Site software

  • Mirror or reproduce the Site on another server

  • Use Safirtec’s name, logo, or branding in a misleading manner

Third-Party Services and Links

The Site may contain links to insurance carriers, payment providers, scheduling services, customer portals, social networks, or other third-party websites and services.

Third-party services are governed by their own terms and privacy policies. Safirtec does not control and is not responsible for their content, availability, security, accuracy, or privacy practices.

The inclusion of a link does not necessarily constitute an endorsement of the third party.

Website Accuracy and Availability

Safirtec attempts to provide helpful and current information but does not guarantee that all Site materials are complete, accurate, current, or free from typographical, technical, or other errors.

Safirtec may modify, suspend, discontinue, or restrict portions of the Site at any time.

Disclaimer of Warranties

The Site and its content are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, Safirtec disclaims warranties concerning:

  • Site accuracy or completeness

  • Uninterrupted availability

  • Error-free operation

  • Security

  • Fitness for a particular purpose

  • Merchantability

  • Non-infringement

Nothing in these Terms limits obligations that cannot legally be excluded or alters the terms of an insurance policy issued by an insurance carrier.

Limitation of Liability

To the fullest extent permitted by law, Safirtec and its owners, officers, employees, representatives, contractors, licensors, and authorized partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • Use of or inability to use the Site

  • Reliance on general Site information

  • Website interruptions or technical errors

  • Unauthorized access outside Safirtec’s reasonable control

  • Third-party websites or services

  • Loss of data, profits, or business opportunities

These limitations do not apply where liability cannot be excluded or limited by applicable law and do not alter obligations created by an issued insurance policy.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Safirtec harmless from claims, losses, liabilities, damages, and reasonable costs arising from:

  • Your unlawful or unauthorized use of the Site

  • Your material violation of these Terms

  • Your submission of fraudulent or intentionally misleading information

  • Your violation of another person’s rights

Suspension or Termination

Safirtec may suspend, restrict, or terminate access to the Site when reasonably necessary to address:

  • Violations of these Terms

  • Fraud or suspected fraud

  • Unauthorized access

  • Security threats

  • Interference with Site operations

  • Conduct that may harm Safirtec or others

Provisions that logically should remain effective after termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

Events Beyond Our Control

Safirtec is not responsible for delays or failures caused by events beyond its reasonable control, including severe weather, hurricanes, natural disasters, power or internet failures, cyberattacks, governmental actions, public-health emergencies, carrier system outages, or telecommunications interruptions.

This section does not excuse obligations that cannot be limited under applicable law.

Governing Law and Venue

These Terms and disputes concerning use of the Site are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes arising from these Terms or use of the Site will be brought in the appropriate state or federal courts located in Miami-Dade County, Florida.

These Terms do not modify the governing law, venue, dispute-resolution provisions, rights, or obligations contained in an issued insurance policy.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

Waiver

Safirtec’s failure to enforce any provision does not waive its right to enforce that provision or any other provision in the future.

Entire Agreement

These Terms, Safirtec’s Privacy Policy, and other legal notices published on the Site constitute the agreement governing use of the Site.

These Terms do not replace or modify any insurance application, binder, policy, endorsement, premium finance agreement, carrier document, or other separate agreement.

Changes to These Terms

Safirtec may update these Terms periodically to reflect changes in its services, business practices, technology, or legal obligations.

Revisions become effective when posted on the Site with an updated “Last Updated” date. Changes will not retroactively expand previously provided marketing or SMS consent.

Your continued use of the Site after an update constitutes acceptance of the revised Terms.
